Official Rules for Loots-Of-The-Week
NO PURCHASE OR FEE REQUIRED TO PLAY.
Void wherever prohibited or restricted by law.
By entering the Loots-Of-The-Week sweepstakes (the "Sweepstakes"), you agree to abide by all
terms of the following Official Rules, which shall be final.
ELIGIBILITY
The Loots-Of-The-Week sweepstakes at the
is open to individual users who have registered as Members of the Vibary Network.
Membership is free and open to people who live, work or have an
interest in
. You can become a Member here.
The Loots-Of-The-Week sweepstakes also requires that playing Members
have legal United States residency and be at least 18 years old.
Employees and their immediate families (parents, spouse, siblings, and children)
of Viba Fima inc., the Vibary Network and its agents and subsidiaries are not eligible to enter.
Employees and their immediate families of the prize Sponsors and their subsidiaries,
agents and affiliated businesses are also not eligible.
Your eligibility to enter the Loots-Of-The-Week sweepstakes may be withdrawn
due to the Bad Conduct rules.
PURPOSE
The purpose of the Loots-Of-The-Week sweepstakes is to (1) reward Members for
using and contributing to the Vibary Network, and to (2) allow prize Sponsors
to promote their business to local consumers.
IDENTIFICATION
The Loots-Of-The-Week sweepstakes require Vibary Members to sign in to the Vibary Network
and be identified. The Sweepstakes cannot be played anonymously.
HOW TO PLAY
Wherever Loot prizes are displayed on the Vibary Network, Vibary Members can click on a prize's
picture or link to indicate their interest of winning that prize. At the end of the week, the
Vibary Network will do the drawings on the prizes, and winning Members will be notified by e-mail.
When select a prize, the Vibary Members must wager a certain number of
ecus from their ecu chest. The more ecu wagered, the greater the
chances for the Members to win that prize. The maximum ecus that can be wagered varies by the prizes offered.
Members can change their ecu wager at any time except Sundays where the Loots-Of-The-Week sweepstakes are drawn.
Members who win a prize will have their wagered ecus taken out of their ecu chest. Non-winning
Members will have their wagered ecus returned to their ecu chest.
PRIZE VALUES
Loot prizes have different values. Their values are given to the Vibary Network by
the prize Sponsors and are shown on the Vibary
Network. The given values are not verified by the Vibary Network nor by any
independent parties, and may not reflect the prices that you can find on the market
for the same or similar products or services.
DURATION
A Loots-Of-The-Week sweepstakes run from Monday to the following Sunday. At midnight on
Sunday, the Vibary Network will not accept any more wagers on that week's Sweepstakes.
DRAWING
After midnight on Sundays, The Vibary Network will
run a random drawing computer program (the "Drawing Program") to
select a winner for each Loot prize offered in the Sweepstakes.
The Drawing Program is designed to run unattended and automatically.
In the case of extraordinary circumstances, the
running of this Drawing Program may be moved to another day or cancelled.
The extraordinary circumstances include
the unavailability of the hardware or software to run the Drawing Program, the detection of fraud
and other things as described in the Limitations of Liabilities.
In the case of cancellation, the offered Loot prizes may be moved to subsequent weeks or
withdrawn, based on indications by the prize Sponsors.
ODDS OF WINNING
The odds of winning each Loot prize depends on the total number of ecus
Members have wagered on that prize, and the number of ecus a particular Member has wagered.
The more ecus a Member wagers, the more chances that Member can win. The less ecus other
Members have wagered on that Loot prize, the more chances a playing Member can win.
The aggregate number of ecus wagered by playing Members is displayed next to the Loot prize's description.
The current number of ecus wagered by a particular playing Member can be found in that member's
My Loots page.
ANNOUNCEMENT OF WINNERS
Winners are notified as soon as the Drawing Program has completed successfully.
Winners will be notified by the following methods:
- By e-mail sent to the e-mail address the Members maintain as part of their Vibary membership
- On the My Loots page of winning Members
- On the public Past Drawings page on the Vibary Network
The Vibary Network and its affiliates are not
responsible to reach winning Members beyond the notification methods described above.
PRIZE CLAIMING
The e-mail notification and the link from the My Loots page
contain the instructions on claiming the Loot prize from the prize Sponsor.
Prize claiming is between the winning Members and the prize Sponsors. The Vibary
Network is responsible to announce the winners only. It does not dictate the method
to claim the prize, the claim window before the prize is forfeited, the possibility of
substitution, the payment of taxes, nor any other issues related to the claiming of
the Loot prize.
LIMITATIONS ON LIABILITY
- All Loot prizes are awarded by the corresponding prize Sponsors. Viba Fima, the Vibary Network and its
affiliates only act as a conduit for businesses, and are not responsible
for the descriptions, valuations and subsequent awarding of the Loot prizes, unless Viba Fima, the Vibary Network and its affiliates are
the Sponsor of the given Loot prize. If an external Sponsor reneges on the prize
or delivers a prize different than what was advertised on the Loots-Of-The-Week
page, the only recourse for the winning Member is to bring the dispute to
the external Sponsor directly.
- Viba Fima, the Vibary Network and its affiliates are not responsible for any incorrect
and/or inaccurate information, for any human error, technical malfunctions,
lost/delayed data transmission, omission, interruption, deletion, defect,
theft or destruction, unauthorized access to, or alterations of, information
and other entries, for failures on the connection lines, equipment and
services that prevent Vibary Members from participating in the Loots-Of-The-Week
sweepstakes.
- The Sponsors (including Viba Fima, the Vibary Network and its affiliates) are not
responsible for any injury, damage or loss that may happen to the winning Members when
using the awarded prizes. If the prizes are directly manufactured by the
Sponsors (for goods) and/or directly provided by the Sponsors (for services),
then the liability of the Sponsors are limited to the Terms of Usage and other
legal notices about using the goods or services, and to existing consumer
protection laws.
- If for any reason the Vibary Network's Drawing Program is not capable of running as
planned, including infection by computer virus, bugs, tampering, unauthorized
intervention, fraud, technical failures or any other causes beyond the control
of Viba Fima, the Vibary Network and/or its affiliates which corrupt or affect the
administration, security, fairness, integrity or proper conduct of the
Loots-Of-The-Week sweepstakes, Viba Fima, the Vibary Network and its affiliates reserve the
right at their sole discretion to take as much time as needed to resolve the
issues, and to
resume the running of the Drawing Program when the issues have been deemed satisfactorily fixed.
If this is not possible, Viba Fima, the Vibary Network and its affiliates
can at their sole discretion cancel the drawing.
- YOU AGREE TO ABSOLVE VIBA FIMA, THE VIBARY NETWORK AND ITS AFFILIATES FROM ANY
LIABILITIES RESULTING FROM PROBLEMS YOU MAY HAVE FROM GETTING OR USING THE
PRIZES FROM EXTERNAL SPONSORS.
IF THE PRIZES ARE SPONSORED BY VIBA FIMA, THE VIBARY NETWORK OR ITS AFFILIATES, YOU
AGREE TO ABSOLVE VIBA FIMA, THE VIBARY NETWORK AND ITS AFFILIATES FROM ANY LIABILITIES
RESULTING FROM PROBLEMS YOU MAY HAVE FROM USING THE PRIZES.
- The Loots-Of-The-Week sweepstakes is governed by the laws of the state of
, in accordance with the laws of the United States.
DISPUTES
As an entrant to the Loots-Of-The-Week sweepstakes, you agree that:

any disputes about the description and awarding of the prizes from external
Sponsors are to be resolved with the external Sponsors directly. The involvement
of Viba Fima, the Vibary Network and its affiliates will be limited to providing the records to any
asking parties for them to build their cases

any other disputes, claims, and other causes of action arising with this
Sweepstakes, shall be resolved individually,
without resort to any form of class action
-
if such resolution cannot be attained amicably, such disputes, claims and causes shall be resolved
in a federal or state court located in the state of
having competent jurisdiction

any and all claims,
judgments, and awards shall be limited to actual out-of-pocket
costs incurred, including costs associated with entering this
Sweepstakes, but in no event attorneys' fees
-
hereby waive all rights to claim, punitive,
incidental, and consequential damages, and any other damages,
other than for actual out-of-pocket expenses, and further waive
all rights to have damages multiplied or increased.
PRIVACY NOTICE
The Vibary Network does not provide prize Sponsors any Confidential information (such as
your e-mail address). The Vibary Network will provide prize Sponsors Public information that
can identify you via your public Vibary membership username, and aggregate Collectable information that cannot
identify you personally. See our Privacy Policy.
The Loot prize selections that you made are considered Collectable information.
The Vibary Network may use it to
highlight to Members that have selected such prize
other products and services from local and national merchants and businesses that may be of
interest to them.
If you are a Loot prize Winner, the Vibary Network will allow the prize Sponsor to contact
you via your public Vibary membership username. The prize Sponsor may require you to provide
to them your real name, e-mail, postal address or any other private information. This is
between you and the prize Sponsor, and is not covered by the Vibary Network's Privacy Policy.
If you are a Loot prize Winner, Viba Fima, the Vibary Network, its affiliates, and
the external Sponsors have the right but not the obligation to use and publish
your Public information (such as your username) and your winning Loot, online and in print, or any other media,
present and future, without any additional compensation to you, but only in
connection with the Loots-Of-The-Week sweepstakes.
If you are a Loot prize Winner, you may also be asked to let Viba Fima, the Vibary Network, its affiliates, the external
Sponsors and their advertising and promotional agencies use your picture, proper
name and likeness for advertising and promotional purposes, without additional
compensation, unless prohibited by law. This is Confidential information,
and you have the right to refuse such request.
BAD CONDUCT
You will be disqualified from winning a Loot prize and may become ineligible to enter
current and future Loots-Of-The-Week sweepstakes if you have been found to:
- tamper with the entry process or the operation of the Loots-Of-The-Week sweepstakes
- use robotic, automatic, programmed and other non-human method to enter
- be acting in a non-sportmanlike and disruptive manner, or with intent to
annoy, abuse, threaten or harass any other person
- act in violation of these Official Rules in particular and the Terms
of Usage in general.
CHANGES AND NOTICES
Viba Fima, the Vibary Network and its affiliates reserve the right to cancel the
Loots-Of-The-Week sweepstakes at any time without the obligation to provide
another promotion in its place. A notice will be published to the Vibary Network.
Viba Fima, the Vibary Network and its affiliates reserve the right to change and
amend these Official Rules at any time. A notice will be published to the Vibary
Network. To stay up to date, you agree to check the Vibary Bulletin for change
notices. Changes are effective on the date the notice is first
available, or on the date specified in the notice if later. YOUR SELECTION OF A
LOOT PRIZE AFTER ANY SUCH CHANGE IS YOUR AGREEMENT TO THE CHANGE.
